Can they really keep my deposit??? --Follow up question?

Okay, so now the fishing boat company is saying they still will not refund my deposit because i canceled after the 90 day time limit. But, they said they would be willing to move my deposit to another trip next year sometime. If I tell them to put the deposit on a trip next year, then call back and tell them to cancel that one, wont my money then be refundable because I am now within the 90 cancelation period for that trip?? When they said they would move my money to another trip, they're claiming I can't do this because I am only "extending" my depost, not placing a new deposit on a new trip. Is this a valid argument or doesn't the contract renew for next years trip and my money now falls under the 90-day limit for next year. Please, some legal help here. For a better background on my first question, look for a question posted yesterday titled, "Can they really keep my deposit???"|||They are only offering to apply your deposit to a new trip as a courtesy. If the application that you filled out says that you have to cancel within 90 days and you cancelled after the time period, they don't have to offer you anything at all.





Do you have any friends who might want to take a trip like this? If so, see if the deposit could be transferred to someone else, and have your friend pay you part of the deposit back.

Read your deposit contract for the fine print details. They may actually be doing more than required by allowing you to "extend" your deposit to another trip. It definitely is not a "new" deposit. Sorry.|||Why don't you go on the trip? I think the company is being very generous. They reserved a seat for you with your deposit and you cancelled. They couldn't sell the seat in short notice, so you lose your deposit. They offer to move your deposit to another date out of the goodness of their hearts, (because they don't have to) and now you want to spit on their offer and try to get around the fact that they are being generous by moving the date in the first place.





Go on the trip.
