Will this be enough to satisfy landlady?

My sister has been having financial difficulties since January (lost her job at woolies) but has paid her rent in full every month - though not always on time (last few months its been a week or two late). Last months rent ( from 20th April to 20th May) has not yet been paid however. Now she has to pay this months rent (due a few days ago on 20th) but had decided to leave and move in with us. Can she just pay the 拢350 for last month and one week of this month if she vacates immediately? Shes ok with giving up the 拢350 deposit as well.





She has lived there since January 2007 and has been perfect tenant (always paid on time up until losing job) - house is immaculate, though obviously after nearly 2 1/2 years their is basic wear and tear.





I understand normally she would have to give at least 30 days notice to quit and be responsible for remainder of any rental agreement. Although she has had a standard 6 month shorthold agreement (renewed 4 times) but it was not renewed for a 5th time last January so currently has no tenancy agreement (a month to month tenant?).





She doesn't want to cheat landlady but cannot afford to pay any more than this without borrowing money, which she wants to avoid if possible. Do you think that payments fair? 拢780 if include lost deposit.|||Firstly I'd talk to the landlady and explain the situation honestly. She may well be understanding but then again-she has bills to pay too. If a fixed term tenancy is not renewed it goes onto a rolling contract-seek advice from Shelter or the CAB, but she will still have the rights and responsibilities of a tenant unless the landlady has served a section notice to quit the property. In any case, if she intends to move, give notice immediately and then the amount owed can be reduced-the landlady may be prepared to accept instalments if she cannot pay the remaining rent immediately.|||It sounds fair enough to me, especially as she has no tenancy agreement, but she'll need to discuss it with the landlady, if she's not is a signed tenancy agreement (as it hasn't been renewed) I don't think the land lady would have a leg to stand on legally if she has a problem with this.|||Why doesn't she apply for LHA towards her rent and be upfront with the landlady?|||Margaret is right. She should claim the benefits she is entitled to. She may be able to get Local Housing allowance or housing benefit, depending on what the local authority is doing with their benefits system at the moment. LHA is relatively new, so its not widely known about. Your sister needs to speak to her landlady as soon as possible. There may be other benefits your sister can claim, depending on her situation. Check the public CAB website below for more information.|||She has got a rental agreement. The last 6mth fixed term, as now become a periodic tenancy, so she can claim BH. Tell her to take it back to council offices.


If she wants out of the property then tell the LL that she can not pay any more, and for her to keep the deposit.
