Can i be evicted in winter with a 7 month old son? Chicago?

My lease is coming to end march 1st, and they do not want to renew it. I don't know why, they wont tell and i know that they don't have to. However i can tell you that we have always been on time with our rent, and we never cause any problems. (that i know of, i was never informed if there was a problem so i wouldn't know.) I had a very good tenet and landlord relationship i would talk to her at least twice a month. so im a little mad, and i decided to use my security deposit for the last months rent. They said they in the lease it states we cant do that. But i cant take the chance that they will keep the sd and im stuck with no way to pay for my next apt. I have to think of my son. I now got a notice stating we have to pay. can they evict me? In the middle of winter with a 7 month baby? so what do i do? do i have any options?|||While you are figuring out what you are going to do keep the big picture in mind. Stealing the rent money is going to cost you big time.





The eviction is going to have a couple of long term effects. For one, you will still owe the money, this time as a court order. For another the eviction remains on your credit report for 10 years, and the landlord can renew it for another 10. This means 10-20 years of not being able to rent a decent place, maybe not getting a job that requires you to be a decent human being, etc. Lastly, you will be disqualified for public housing assistance, and it sounds like you are thinking of section 8. This will not be an option for you.





You can be dishonest if you want, just keep in mind the long term effect you are placing not only on yourself, but your baby. Unless you can buy a house you will be living in slums for at least 10 years just to steal a few bucks.|||A security deposit is "not" rent, it's for the protection of property owners.


Maybe the owners want to do some work on the property, raise the rent or other reasons they want you out. They don't have to give you an expanation.


Yes, they can evict you--it is your responsibility to take care of your baby--not your landlord.|||Sure, being a single mother doesn't mean you don't have to pay your bills.





When you decided to use the security deposit for the last month's rent...that was for damages, not rent, so YOU were in breach of contract.





OK..your lease is up March 1...they can't get an eviction in 3 weeks.





I am assuming you have somewhere to go?





PS: They cannot legally charge you for wear and tear...that is not a legally collectible expense.|||They can evict you. The will give you thirty days to move. You should check into programs that will help you. Section 8(HUD)or whatever it is called in Chicago helps people that can't afford rent. There should also be other emergency programs you can check in to.|||sadly but yes you can be evicted,people just don't care these days.Find someone else to stay with.








goodluck|||You can never say, 'I want to use my security deposit as my last month rent' The security deposit is for the damage you may have cause. And I know, there is no damage right? Well you don't have that much to worry about. They can not charge you for Ware and Tare. Just damages, holes in the wall, and just things that are not the same. You only been there for a year so they probably do not expect to much ware and tare. But clear the apartment of all your belongings, clean the carpet, clean the walls and then you should be good to get majority of your security Deposit.|||If you are such a good tenant, then they have no reason to not renew. If they did have a reason, they would have told you why. Your lease has a renewal clause. I means that you and the landlord CAN renew the lease. He can only not renew with valid reason. I would let him try and evict me. This way, if you are definitely in the right, your side will be heard by a judge. Since the landlord has not given you a reason for non-renewal, I suspect that he probably has another tenant (possibly a relative) who needs the place and will willing to pay much higher rent. The landlord is taking a chance that you'll just move out. Call his bluff. Go to court. You'll probably win. Either you will win or the landlord (who knows all about this stuff) will try and make a deal with you prior to the court date. If that happens, you know you've got him by the tail. ps - the time of the year has nothing to do with your claim or his claim. Good Luck.|||Evictions do not stop just because it's winter.





Having a child does not give you any more rights than a person without a child.





It is illegal to use your deposit for rent. They can sue you for not only unpaid rent....you will also be sued for late fees, court costs, attorney fees %26amp; filing fees. Also...having an eviction on your record will make in next to impossible to rent elsewhere in the future. This is where you really should be thinking of your son.





You made a very BAD move trying to pull that stunt. It will cost you a helluva lot more in the long run.
