Question about private rented house?

i been living in my house since 28th of august 2008 and had a 12 month tenancy. my landlord is a pain right she said if you need anything write to me. so when we didnt have a weelie bin wen we moved in we wrote to her and asked for 25 quid for the bin but she never got back to us.





and then we found out she was supposed to put our deposit money into the deposit protection scheme within 14 days, she put it in 12 months after (1/9/2008). we found this out because we had a letter of the deposit protection scheme saying she put the money in, and i read the small print and it said





"if your landlord does'nt put the deposit into the scheme within 14 days since the date of the tenancy started, the landlord is liable to pay 3x the amount of the deposit to the tenants"





and she hasant renewed my tenancy.





i am trying to get a council house for the cheaper rent, but one of the housing associations have written me a letter sayin they cant give me a house because i am behind on my current rent. when im not! i am giving my landlord the agreed amount id give her, and technically i dont have to give her anythin cause she hasant renewed my tenancy (it has been over 10 months since my 12 month tenancy i got when i moved in ended)





what is she playing at? is she trying to skip the tax man or what??





im doin everythin like paying on time and she thrown it back in my face by saying im in arrears when i aint|||You have to appeal to the council house and request investigation of the problem. You won't be able to fix anything without knowing where's the problem is. Then prepare the rent receipts/canceled checks to prove yourself paying rent on time every month with a copy of the lease. It may be either the mistake of your Landlord or the Council house. Good luck.|||My Dear, you are being ripped off by an unsrucpled landlady.





There are rogues about, and it seems like you have found one.





Once you have other arrangements in place, to move to, I would withhold rent for a couple of months or so, to get back your deposit and anything else.





Leave the place in good condition, hand in the keys with no forwarding address.





I hate being taken for a fool also|||Not a good specimen of a landlady.





After your 12 month tenancy expired you would have reverted to a month to month basis. You can demand a rent book to prove your payments - I hope you've paid by direct debit or cheque as proof of payment.





You can take the matter up with deposit protection scheme - after 2006 your landlord was legally obliged to deposit the monies in this scheme. There are mitigating circumstances - I deposited a deposit after 4 weeks because a tenant didn't sign the agreement correctly and I wouldn't technically go ahead with the let until the agreement was returned to me with all signatures intact. As soon as that arrived, however, the monies were transferred. No such thing has happened here - your landlord just didn't do it. Take the option to sue up if you wish.





Your landlord should have sorted out the arrangements for the bin -not you paying up front and claiming back.|||The dates. I am presuming you have them wrong? 28th August 2008, 12 month tenancy and something about her protecting your deposit 12 months late (1/9/2008)?????





Allowing for my confusion/or your errors with dates - she may have simply changed the way she is protecting deposits and you have been notified of a change in that protection





The bin - it is your responsibility to pay for the bin at your property. You can of course take it with you when you move.





Renewing tenancy - there is no need to do so. Once a tenancy 'expires' it reverts to a month to month rolling tenancy. You still have to pay rent and I find it amazing that you think 'technically' that you dont!





As for rent arrears you should ask her for a statement of rent which will show all payments made with dates etc. You can then prove you have paid your rent up to date as you say.





As for 'trying to skip the taxman' I really don't know where tenants get these ideas from. There is most likely a mortgage on the property and the taxman will be perfectly aware of the fact.|||firstly why did you pay 拢25 for a wheelie bin, if you contact your local council they will give you one free of charge. so not sure about getting that back.





secondly your landlord does not have to renew your agreement, if can be placed on a month by month rolling agreement which means either your or they only have to serve a months notice, to move out rather than the usual two, if you want to have a longer agreement it is your responsibility to do this, and yes i am afraid you do need to keep paying your rent, you live there you are liable for the rent until you serve notice to quit.





As for the deposit, i would contact them and find out why they did not do this within the 14 days.





As for the housing Association, i would write to them and tell them that you have indeed paid your rent on time, either your bank statements should show this if paid by standing order or receipts if paid cash in hand.
