Did our landlord breach our contract?

We signed a lease 1 year ago. The landlord said if we choose to renew our lease after the year, and the home was in good shape, she would refund $1000 of our $3250 security deposit. We are clean people and we have painted and performed several upgrades to the home, all of which the landlords likes and approves of. The home is immaculate, even nicer than when we moved in. I was under the impression that the money would be refunded, and when I signed she said we could talk about it after the walk-thru. After signing an addendum to renew the original lease, the landlord informed me that she would not refund the money. She had no reasoning, as I am never late on rent, and the house is seriously flawless. She did note on the top of her copy of the agreement, that the money would be returned, as I reminded her after we signed the original contract 1 year ago. This is the second time she has went back on her word, as she also promised to buy the paint if I was willing to supply the labor to do it. After the painting of 5 rooms and entry was finished, she changed her story. What can I do? Do I have a 3 day right to rescind in California. I feel totally taken advantage of.





thanks all.|||There is no "3 day right to rescind" in renting. It only applies to buying a product. Its called buyers remorse. So if you signed the lease, you are stuck with it. Unless it states that she would return a specific portion of the deposit in the lease, you are out of luck. Sorry|||i would check with a lawyer and see what he/she has to say about it.


but seriously i don't think that you have a case. when you are dealing with rental property you are dealing with one big headache.|||You stated she noted it on top of her copy of the contract. Do you have a copy of the same?
