Legal question about time limitations to sue?

So I had an ex-landlord screw me out of my deposit. He is notorious for ripping people off.





This is the second time I've rented from him and the first time, he tried to rip me off too, but, I caught it and had him served. He didn't want to go to court and settled out. Texas allows for triple damages but, I only asked for what I was owed, cutting him a break.


(I thought my good past record held weight with him, is why I rented again)





I was going to sue for this latest event but, I got busy and didn't. He kept my deposit of $700 for cleaning. I had cleaned till 4 a.m. and hired a professional carpet service. He also added another $178 above the deposit and entered it onto my credit report when I refused to pay it. I moved out in August of 2008. I had always paid my rent on time (or before) and in full.


So, I forgot about it, figuring I'd never rent from him again. In Texas, I think the limitation to file a claim is 2 years.


But, if a creditor is after you, it's good only for 7 years. Unless you send them a payment or contact them, then it renews the 7 year period.


Is it the same in this case? The landlord had a collection person call me for this money in March of 2010. Does this renew the time limitation to sue in court?


I am gathering evidence, in preparation. I hope someone knows the answer.
