Is it legal a landlord ask you to repay again the security deposit to renew the leasing contract?

I have been living for 4 years in this apartment and I take care very much of my apt. I pay $900 dollars for security deposit when I moved in. Now, I have to renew the leasing contract and they are asking me for another security deposit, this time for $940. Why I have to pay again for a security deposit? Is that legal? What can I do for not paying this unfair security deposit?|||Yes this can be legal. If your landlord spent the original deposit on your damages already (you had him fix things you broke) then he can ask for an additional deposit, because there no longer is one available.|||That is odd...........I've never heard of that before. The thing is, it's probably a state law -- you need to check out your state's renter's rights -- google it but type in your state.|||It is legal, if they refund your first deposit back to you and then have you pay again..basically...they can ask for another $40..but if you pay your rent on time and take care of your apt. I would sue the hell out of the management company.|||it is not legal if he wants more for deposit say $940 he has to refund your $900 first plus interest because landlords have to put the money into a bond account, then if you still want to rent there he can charge whatever for new security deposit as long as it is seen to be a fair price which should not be $1840|||You shouldn't have to pay it again. If they require it, you should require them to do a walk-through decide what might need work, and refund you any portions not needed to get the work done. Be careful what they charge for though, most places after that long they would have to replace the carpet and repaint so that should NOT come out of your security deposit.|||no! You already paid one! If you were to move out, he'd have to give it back to you. Instead, you're staying there so there is no reason for another one.





Call a legal help center in your area and they can send you the tenants handbook for your state and it will have all the rules in there.|||NO it's illegal....you already paid the deposit and you are already there. Infact, if you move, he has to give you interest on the security deposit + all of it back if there is no damage!!. Contact your local landlord and tenants branch and ask them what to do. It seems like the landlord is trying to pull a fast one on you and if you say know he might now renew your lease...but he can't NOT renew your lease because of that reason....you have to make a record of it and get some help...like quick!!





Hopefully you have a receipt!! But it should be on your old lease....make a copy quick!!|||You should not pay another security deposit. Sounds like to me that they are raising your rent from $900.00 to $940.00. Why they're calling it another security deposit is beyond me but, do not pay it until you find out for sure. Should not cost you another deposit.....never heard of this before. Are you sure that you understood it to be another security deposit.; or is it another lease showing they are raising your rent???|||that is ridiculour you only pay the bond once not every time the lease is renewed that means when you leave your land lord would have to repay you the bond twice over, go see a lawyer and get legal advice not that you need it in the sense of being evicted just so you know whatt o say to your landlord because you only ever pay it once|||It is definately not fair, but may be legal. As long as your total return for your deposit will be $1840. The problem is if you are renewing your contract and refuse to pay your landlord can simply raise your rates as much as they want to make up for it. It all depends on how much the place is worth to you.





FYI The expected life of a carpet is 5 years. If you live in a place for 5 years you should not be charged for carpet replacement on your deposit.|||He can only ask for the additional $40 dollars not for the whole amount. He is also suppose to pay you interest on the security deposit that he has.|||They should refund the original security deposit. They should not ask for two security deposits.
