Do I have to pay another security deposit?

I been living at my apartment since 2010. I renewed my lease for the second time and its about to be up. Since I missed the "60 day notice" to let them know I would be moving out, my husband and I decided to go ahead and renew our lease but instead of staying in the same unit, we told them we wanted to upgrade to a 1bd/1study unit. Which they said they had available. They said I would have to pay a transfer fee and a new deposit fee. I understand the transfer fee but do I really need to pay another deposit fee? My cousin works at another apartment complex and she herself said according to the TAA (Texas Apartment Association) I DO NOT NEED TO PAY ANOTHER DEPOSIT FEE! She said they only tell me that so they can keep it or earn their commision or whatever. I told the office what she said and they said no, I have to pay another deposit. I tried looking online at the TAA website but I cant find anything on it. Will someone please help me with the correct info.|||Yes, you would pay another deposit because your first deposit is for the apartment that you would be moving out of (meaning it's for any damages to that place). Your first depost will be refunded to you (if there were no damages) with the time period specified by TX law. Your new deposit will cover any damages that occur in the second deposit. I know it stinks from the tenant's viewpoint, but think about it from the landlord's viewpoint... what if you move out into a different apartment, and then the landlord finds out you've got $400 worth of damage in the apartment. If you damage the next place as well, it's likely that the one deposit wouldn't be enough to cover the damages to both units. It's no different then if you would have moved into a new complex and paid another security deposit. If your unit has no damages, then you should be entitled to your entire deposit back.|||Yes.
