Can the property mgmt ask for another deposit if I want to renew my lease for another year?

We moved into the apartment in May of 2008. Our credit wasn't the greatest and we were denied at first but I asked if we could use a cosigner to get us in and they said yes. My dad cosigned and has great credit, but we still had to pay a high security deposit of $1200. Now that our lease is almost up, they sent us a notice last month asking us to renew it again. The letter they sent sounded a little desperate for us to renew and promised us that if we did, we would only see 1 rent increase over the next 2 years of only $20. The letter said to sign it and return it and they would prepare our new lease agreement. I didn't turn it in yet and yesterday I received a phone call from the property mgmt. They guy who called me sounded like he was making everything up as he was going along and kept taking long pauses while he was talking to me. Basically he said they definitely wanted us to renew but that we had to reapply and do another credit check and pay another deposit according to how our credit was and considering we weren't going to have a cosigner this time around because my dad only wanted to cosign for one year. They still have our $1200 deposit from last year and they haven't done any inspections or have had to fix anything major that I know about. We're good tenants, always pay on time too. Is it legal for them to ask for another deposit even though they still have our $1200 deposit from last year? I feel they're taking advantage of us and trying to get more money because of the economy and there are several apartments vacant that they can't fill. Is this right? Can they do this?|||Yes they can do this. Either have your father co-sign again or pay the additional deposit...or move to another place that will accept you credit history.|||they can ask for anything they want. what i would tell them is that you will renew your lease for a year with no increase in rent and no more deposit or you will be giving your 30 days notice to move and if they agree to that then make sure its all in writing before you sign anything.|||no, they can't do that. call a tenants' rights agency, or tell the landlord that what they are asking is illegal.|||I live in an apartment and this will be the 3rd year that I will be renewing. All I do is sign the paper and give it to the landlord. The security deposit should only be given one time at the start, not every year. I wouldnt pay another $1200. If they want you to pay it again, I would ask them to inspect the place and return the deposit so that you could re-issue it. The security deposit is there for when you LEAVE, so they can repair any damage after you have moved out. I highly recommend that you do not pay another security deposit.|||That's BS.


I suppose they can ask for a security since you won't have your dad guaranteeing the rent since he will be removed from the lease, but it does sound as if they feel they can put you in a corner since your credit was shoddy when you applied. Have you paid every month on time? I would think if you have, they need to just be glad for that, and that you are willing to sign a 2 year lease.|||they can't do that really.


move out if they want that 1200. they might just want u out or they are desprate for money
