How do I get my security deposit back?

I moved out of the house (rented it with 2 other people) about 8 months ago and still haven't gotten my deposit back. Before I moved out I notified my landlord that my boyfriends dog had broken a piece of the blinds off. About 3 months ago I started to really put a pressure on her to give back the rest of the deposit but still no luck. I've called her repeatedly and emailed and on several occasions we have set up a date for her to give me it back, but she kept flaking out on me.





Now only 2 weeks ago, she informed me that I couldn't get my deposit back unless the guy that is now renting my room would pay the second half of his security deposit. She said that since he took over for me on the lease he will be also taking over the responsibility of deposit.


Is that even possible? I moved out after over a year of living there, and I thought that the lease said it was a year contract, maybe it automaticly renewed itself to another year. Unfortunately I don't have my copy any more.


But even so if it did, I did give her a written notice (with more than a month advance) and I found a new tenant for the room. And not to mention she never said anything about him being responsible for me getting my deposit back on time.





I hope somebody can give me some advice on what to do next, where I can file a claim or whatever you do. (I live in California)


Thanks in advance|||If you have someone who has taken over responsibility for your lease agreement, you have a mess on your hands. Unless you finish out a lease term cleanly, these issues can arise. You do not give enough information to advise you where you stand, since you do not know exactly if you had an extended lease or not.|||You do not get the deposit back until ALL roommates vacate. If one has stayed then you are not getting it back until they leave.





How long you lived there is immaterial. Most leases go to a month to month and many do auto renew. How much notice you gave is also immaterial.
