Can they really keep my deposit???

Okay, so a fishing boat company is saying they still will not refund my deposit for a trip because i canceled after the 90 day time limit. But, they said they would be willing to move my deposit to another trip next year sometime. If I tell them to put the deposit on a trip next year, then call back and tell them to cancel that one, wont my money then be refundable because I am now within the 90 cancelation period for that trip?? When they said they would move my money to another trip, they're claiming I can't get a refund because I am only "extending" my deposit, not placing a new deposit on a new trip. Is this a valid argument or doesn't the contract renew for next years trip and my money now falls under the 90-day limit for next year. Please, some legal help here|||My understanding of your situation is as follows: They clearly said that they would not return the money due to your failure to comply their policy. So in a sense they were being "nice" to let you use that same money to reserve another trip, when in fact they could have made you pay another deposit, making it an entire new "agreement"...so, I'm sorry to tell you that you're assed out :(|||You gave them a deposit to secure a reservation for a spot on their calendar and would expect them to have that available for you. To do so, they potentially have to turn down customers or rush around to fill the spot, if at all possible. That is a type of performance contract between you and the owner. The deposit keeps people from making reservations without regard to the impact to the owner and compensates for lost revenues. By cancelling the trip, you gave up all rights to the deposit.





This company, like many, realize that, even though deposits are necessary, cancellations can occur and people will be upset by the loss of the deposit. To help mitigate your feelings, they have been kind enough to allow you to extend the deposit to cover next year's trip.





But, that's not good enough for you, so you want to try and use the system against them.





If you did that to me, I would cancel the extension and keep your deposit from the first trip and remind you that your deposit was lost the first time you cancelled. I would keep your name in my records and would never want to rent to you in the future.





Obviously, those people aren't dumb and keep good enough records to know which people are trying to screw them out of the money that they are rightfully owed.|||You lost your refund. You missed the dead line.





They gave you a generous offer.

Possession is 9 points of the law.|||they surely can keep your deposit and you should feel so lucky they are going to let you use it for a different trip. if i were you, i'd book another trip.|||Quit whining. You are lucky they are willing to extend your deposit at all. They are not required to do that, they are offering that as a courtesy to you. If I was the fishing company I would tell you to F off and never come back, if you pulled this crap.|||Suck it up. Deposits are made for a reason, quit whining.|||they are doing you a favor, because you didn't cancel it in the 90 days limit
